• No payments can be made from the estate to people or organisations that are bankrupt. This includes any gifts to beneficiaries and debts to creditors. In order to avoid doing this, it is the responsibility of the Personal Representative to make sure that no one who is benefitting from the estate is bankrupt. A simple way of doing this is through utilising this free, online service: http://www.insolvencydirect.bis.gov.uk/eiir/. If a beneficiary is bankrupt then any gifts left to them in the Will must be distributed to a trustee of the beneficiary instead.
